Damage Waiver Terms & Conditions shall apply to any damage waiver arrangement between ‘Scotloo / Scotbox’ and ‘Hirer’ unless otherwise agreed.
Damage Waiver Plan should be read in conjunction with Scotloo / Scotbox Terms & Conditions of Hire.
Scotloo / Scotbox undertakes, subject to an extra payment as stated on the rental contract, to offer a waiver to cover damage to equipment hired by the ‘Hirer’ whilst in their possession.
This Damage Waiver Plan must have been agreed prior to delivery of equipment.
This Damage Waiver Plan does not exclude the Hirer’s liability for the following: –
Any costs, claims or hire charges incurred by Hirer arising from any breach of contract.
Loss or damage occurring as a result of any negligence by Hirer, failure to provide adequate security on sites, any criminal act or vandalism by the Hirer.
Loss or damage to Hirer’s own equipment, property or ground.
Loss or damage to neighbouring equipment, property or ground.
Hirer must ensure that adequate steps are taken to limit damage being caused to equipment.
Scotloo / Scotbox reserve the right to revoke the Damage Waiver Plan and recover costs for repair to equipment if: –
The Hirer is in arrears for rental charges
Hirer fails to notify Scotloo / Scotbox of any damages within 24 hours of being notified by sites
Any alterations or modifications are made to equipment by Hirer
Any breach of the Terms & Conditions has been committed
In the event of loss or damage to equipment by a third party, it is the responsibility of the Hirer to notify Police. Scotloo / Scotbox must be notified of Police Crime number.
Scotloo / Scotbox liability for any loss in all circumstances will be limited to and will not exceed the cost of the hire equipment.
The Hirer will be liable for personal injury or death arising from the actions of the Hirers’ employees.
Scotloo / Scotbox reserves the right to withdraw this Damage Waiver Plan, with 28 days’ notice in writing.
These Terms and Conditions do not give the Hirer’ any rights of ownership to the hire equipment.
Subject to above clauses, in event of any loss or accidental damage to hire equipment, Scotloo / Scotbox will waive the Hirer’s liability for repair costs.
